contract termination fee

Over a year ago I purchased 3 cell phones for my family. We signed the ATT contract at Best Buy. Several months later, the "add a tablet for $10 month" ad made it's way on the scene. I added my Kindle HD online. After several months, I realized I use the tablet mostly at wifi spots, so why pay for data? Then comes the share plan for $160 for 4 phones with 10GB. I contact ATT via chat and ask about best/cheapest way to proceed....add phone and keep tablet? Swap tablet "line" (it was issued a phone number although it has no sim card) for a 4th phone line?

 

The latter was deemed  the better option. Off we go to the store. Suddenly there's a contract termination fee om the tablet! What contract? I signed nothing, there was no box that needed to be checked on the site to show my agreement to a contract. How can a line/product/service be added to a previously set up contract without notice? $10 a month was all it said. Then, to add insult to injury, I'm charged taxes and fees on the fee!

 

The oddest thing of all is that the 4th phone added to my plan is NOT under contract! I was told today the reason behind that is - it is cheaper. And yet the tablet price was cheap because it WAS added to the contract.  Please explain this to me.
